Limitation of liability
To the fullest extent permitted by law, RIPPED and its officers, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to the website. Our aggregate liability for claims relating to the website will not exceed one hundred U.S. dollars, except where a different limit is required by law.
Individual arbitration and class-action waiver
You and RIPPED agree that any dispute arising out of or relating to these terms or the website will be resolved by final and binding individual arbitration, not in court, except for an eligible individual claim in small claims court or a claim seeking injunctive relief to protect intellectual-property rights.
The arbitration will be administered by the American Arbitration Association (AAA) under its then-current Consumer Arbitration Rules. It may be conducted by telephone, video, written submissions, or in person as the rules permit. The Federal Arbitration Act governs this provision. Judgment on an award may be entered in any court with jurisdiction.
RIPPED will pay the administrative fees and arbitrator compensation that the AAA rules require a business to pay. Each party will otherwise bear its own attorneys' fees and costs unless applicable law or the arbitrator permits an award. Current AAA consumer rules and filing information are available at adr.org.
Disputes must be brought only in an individual capacity. Neither you nor RIPPED may bring or participate in a class, collective, consolidated, mass, or representative action or arbitration. There is no opt-out from this arbitration provision.
Governing law
Except as governed by the Federal Arbitration Act, these terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. Any court proceeding permitted under these terms will be brought in a state or federal court located in New York, and each party consents to jurisdiction there.
Changes and severability
We may update these terms by posting a revised version with a new effective date. If any provision is found unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
